Trump has vowed to appoint a reactionary Supreme Court Justice, to overturn Roe vs Wade and confirm Heller and Citizens United and other ugly rulings. The Supreme Court has nearly absolute power, with no Justice ever having been removed: once Trump names what he calls "another Scalia". to our Supreme and unaccountable Court, he will cast the longest shadow and reverse decades of progress and confirm decades of reactionary court activism.
The tragedy can be avoided, or at least stalled in the next
two weeks: WE can block this huge tragedy if we mobilize NOW! Or at least, we can have a reprieve and hope that Trump's power is weak when this temporary/2 yr appointment, under Article II of the Constitution the right wing wants us to follow.
. By then, with a disapproved President Trump, Democrats have may have gained
enough Congressional traction to block a reactionary appointment. This is our only chance to stop 30 years of reaction and crushing of the progressive momentum we now have.
Here's the deal: under the Constitution, the President can make court appointments during a Senate recess. The senate's last recess before this session ends is Nov 24-28. Obama can appoint a "liberal" Justice during the Thanksgiving recess (unless the Repubs decide to stay in session..a possibility if they think Obama will use his Constitutional power to crush Trump's most important power (beyond starting WWIII). The sooner, the less outrage that he would have the gall to use his Constitutional powers! But, at the same time, it should be kept quiet not to alert the Republicans of what is brewing. How can we "make Obama do it" without warning the Republicans?
This will not happen unless we the people make a massive demand on Obama to act; We know he wants to act, but as FDR told labor leaders when they urged him act: Make Me!
This appointment, which could be made during the Thanksgiving Holiday would last until the end of the next Senate Session,not the current: that means the appointment would last for 2 years....and by then, Trump's approval may be deep in the tank, as people realize he is putting the old Republican establishment in charge, with a few white nationalists to keep the "morons (his word)" who elected him happy. A very weak President may choose NOT to go against 80% of the people...
There are petitions I will link to sign to make this demand but it might also require letters, phone calls, all on the QT, to give him cover to pull the rug out from under the greatest power and harm that Trump is about to seize. There is nothing anybody can do to block Obama (other than cancelling the recess) , so it is a question of quietly mobilizing the demand. Most Americans support the overturn of the very rulings Trump wants to make more or less permanent...at least for a generation or two since Republicans on the court are young and Dems are old.
With a strong public demand, Obama can prevent 30 years of increasing reactionary politics and the end of reproductive health rights. The vast majority oppose these Trump/Scalia-like changes and
so there IS public support...but it must be mobilized quickly.
We can, despite Trump , who won with fewer votes and is still feared and disapproved by most Americans, win! We can win the big battle for a progressive Court, or at least stall the Trump appointment and hope his Presidency implodes, which is likely since it is based on lies and full of those who failed under Bush.
