THE ABOMINABLE STATE OF OUR COURTS

Ah, geez, here we go again.

These past few weeks the Rovian strategy has been to move attention away from all the foul-ups of the past five years, beginning with three illicit elections and their intentional non-recounts; through the debacle of 9/11/2001; failed attempts to "capture" Osama bin Laden or break the back of the Taliban; the wholly illegal invasion of Iraq, with less than adequate planning; and its next phase - attack Iran with fear as justification.

During this period there's been a whirlwind of tactical White House political psyops: Attacks on the media (for finally doing its job, almost); wholesale musical offices, including Herr Oberst Karl Rove and Dark Lord the Dick Cheney crawling back into their dark, dank lairs where the nefarious plots may be hatched unseen; a conveniently-timed battle of wills with President Vincente Fox of Mexico, stirring up a heretofore dormant "illegal alien" problem; blame laid upon the auto industry, not the oil conglomerates, for rigged skyrocketing gas prices.

Don't forget the neverending ideological theocratic message that it's the responsibility of America to turn the entire World into a democratic Garden of Eden - no matter how many innocent people we have to bomb into submission to reach that goal. Amen.

Now, while he thinks nobody's paying any attention, George W. Bush is trying to force a quickie vote on two judicial nominees who've previously been denied elevation to Appellate Court benches, Terrence W. Boyle and Brett Kavanaugh.

And they've been denied for some damned good reasons"

Boyle sits as a U.S. District Judge, appointed to the Eastern District of North Carolina by Saint Ronnie Reagan in 1984. He had served in 1973 as a Legislative Assistant to Senator Jesse Helms.

As a judge, he is somewhat on the clueless side of fair, open-minded and wise. In reality, Terrence is more like a boil on the backside of Lady Justice.

Father Bush nominated Boyle for the Fourth Circuit Court of Appeals at the request of good Jesse Helms. The nomination lapsed when Bill Clinton became President in 1992. In one of his patented hissy-fits, Helms refused to approve the nominations of any other judges from North Carolina for the Fourth Circuit during the next eight years.

As soon as possible, King George made Boyle one of his four nominees for the Fourth Circuit - unsuccessfully. So, instead of coming up with a new, reasonable nominee, we're on that same merry-go-round once more.

According to THE ALLIANCE FOR JUSTICE, www.independentjudiciary.com, Boyle's decisions have been reversed more than 150 times by the Fourth Circuit court.

Now, I seem to remember King George XLIII and his posturing about not wanting "activist judges" on the courts. Reason holds that when the most right-leaning appellate court in the country reverses one judge twice as often as any other, it's painfully evident he's an activist.

This guy's so wrong as a District Court judge, only a complete fool would nominate him for a lifetime appointment as an appellate court justice" oh, yeah, complete fool, hmm...

Here are some of Judge Boyle's greatest hits:

Repeatedly criticized for tossing cases without allowing individuals, i.e. civil rights plaintiffs, proper opportunity to be heard;

Refusal to review decisions of magistrate judges, ignoring the evidence of plaintiffs and contested factual issues prior to dismissing cases on numerous occasions, thereby violating procedural norms;
