Eminent Domain - a Gift Horse or Trojan Horse? Using the power of Emninent Domain to enable a public/private partnership to seize certain mortgage loans and compensate their alleged holders is akin to another back door bailout. Using ED is a good idea. Conceding administrative authority to private equity capitalists with self serving agendas may not be a good idea.
