Assault charges should have been filed instead of relying on a new law.
While the defense attorney in this case stated that she had a “good time”, this article also reported that she did try to escape this captivity. Marcus threatened her by exposing these acts to her parents by placing it again on his web site. I do not know about you, but having one skull bashed into a metal beam is not my idea of a good time. His reaction to her abuse at the hands of this predator was misogynistic.
Normally, I am for government keeping their business out of our bed rooms but in cases such as this where death can occur, it is the responsibility of the government to step in and prosecute those who do commit acts such as this. As far as consensual sexual play which takes part in this BDSM sub-culture it is up to the individual to protect themselves as well so we do not hear of a body being found or a woman being violated so heinously.

In reading up on this sub-culture, the moment the submissive participant cites a safe word such as no or tries to escape as Jodi did, there is no consent to any act taking place after it. Take the consent away and what you have is rape. This is where the government should step in. Besides rape is illegal and does carry a harsh sentence in most cases.
On behalf of Jodi and those like her who do find themselves in the midst of a sexual predator such as Glenn Marcus, I do hope that this case is retried where the ultimate sentence is harsher and not just nine years.
