Robert Maclean was an air marshall. He blew the whistle when TSA made a really bad call, so bad, that once congress found out about it, they rectified it right away. But TSA has tried to destroy MacLean. I met him six or seven years ago, when we were working together, talking to members of congress, advocating for improved whistleblower protection laws.

Supreme Court Supports Whistleblower-- Sans Sotomayor

Supreme court ruled that a violation of an agency law or regulation does not hold the same weight of breaking the law.

July 2003-- disclosure supported by HIllary Clinton, John Kerry, and many others in congress.

TSA-- charged with unauthorized disclosure of security information.

Accused of most heinous act, but for five months allowed him to continue to have access to classified information.

Court of appeals ruled TSA was within its power but--

Merit systems protection board-- system within federal executive branch reviews personnel matters--

Bush and Obama appointed boards ruled against him.

Federal circuit appeals court ruled in his favor.

Admin appealed

He appealed and won again.

Govt appealed to supreme court-- he won 7 to 2

Rob: What did Sotomayor say? How did she justify her dissent?

Rob: So you've won in the supreme court. Now what?

agency admitted it made a mistake, at end of the day, they ruled that their plan was a mistake and members were in outrage about their plan.

Rob: What is left for you to get your life back?

Rob: will you get your job back? Will they pay you back?

Rob: what is the precedent that they are trying to argue for.?

ONe of their regulations holds the same weight as the law--

Rob: this is like a catch 22-- they destroy you financial and then because of your financial situation, they won't give you a security clearance.

Rob: What have you been doing in the past twelve or thirteen years.

Rob: What happens in the best case scenario?

Rob: is there a possibility that you'll get the back pay after all these years?

Rob: who did your legal work.

Rob: has your process you've gone through had any affect on the law, on policy.

Rob: are there any whistleblowers whose cases might be affected by the decision on your case?
