I instructed the AI app, Perplexity:

"Identify 25 cases in which SCOTUS judges Thomas and Alito have sided with anti-democracy , fascism enabling decisions. Include how these decisions have weakened democracy or enabled fascism."

Here's what it generated. (I've been discovering, in conversations with people over 50, that many are suspicious, and highly reluctant to try these AI apps. Apps. And I understand concern about how AI could develop into something like shone in the Terminator movies. But the reality is that this kind of AI app is a highly useful tool that is becoming ubiquitous, often functioning even in simple Google searches.)

Here are 25 Supreme Court cases and actions where Justices Clarence Thomas and Samuel Alito have sided with decisions that have weakened democracy or enabled anti-democratic outcomes. Each decision is followed by a brief explanation of its impact.

1. Alexander v. South Carolina State Conference of the NAACP (2024)

Alito authored the opinion allowing a racially gerrymandered map to stand, making it much harder for Black voters to challenge discriminatory maps and eroding the Voting Rights Act82.

2. Shelby County v. Holder (2013)

Both joined the majority gutting key protections of the Voting Rights Act, enabling states to pass restrictive voting laws that disproportionately affect minorities9.

3. Brnovich v. Democratic National Committee (2021)

Both voted to uphold Arizona voting restrictions, further weakening the Voting Rights Act and making it harder to challenge discriminatory voting laws9.

4. Rucho v. Common Cause (2019)

Both joined the majority ruling that partisan gerrymandering is a political question beyond the reach of federal courts, allowing extreme manipulation of electoral maps9.

The slew of anti-democracy measures passed and pending - especially the SAVE act, which would effectively LOSE the elections for Democrats forever - is why Democrats cannot count on winning the mid-terms, no matter how unpopular Trump and his enabling Republicans get. Taken to its literal definitions, the SAVE act would prevent anyone who's ever had a name change from registering to vote, unless they had a very specific name change form, presented to a clerk, along with proof of the old name. This could effect as many as 70m married women who take their husband's last name alone.

Preventing potential Democrat voters is a major part of the plan to end democracy as we know it, to enable something as restrictive as Jim Crow and pre-19th Amendment allowing women to vote. Trump and the Republicans truly want to return to the 19th century gilded age. Trump admires and wants to return to McKinley's tariffs and also the lack of regulations and benefits of that era.
